A growing legal fight between prediction market operator Kalshi and officials in Montana is drawing fresh attention to how these platforms should be regulated across the United States.

Kalshi Seeks Court Protection in Dispute with Montana Regulators

The company has launched a federal lawsuit to stop state authorities from enforcing gambling laws against its operations. Filed in a Montana district court, the complaint targets senior officials, including Attorney General Austin Knudsen, and asks for immediate judicial protection while the dispute is resolved.

At the center of the case is the classification of so-called event contracts. These instruments allow users to trade on the likelihood of real-world outcomes such as election results or economic indicators. Kalshi maintains that such products fall under federal derivatives rules and should be supervised by the Commodity Futures Trading Commission (CFTC). The company argues that this federal framework overrides any attempt by individual states to treat the activity as gambling.

Montana regulators have taken the opposite stance. Earlier this month, the state’s Gambling Control Division issued a warning ordering Kalshi to halt its services. Authorities indicated that failure to comply could lead to legal consequences, including potential civil or criminal action. Their position is that the contracts resemble wagers and therefore fall within the scope of state gambling restrictions.

The dispute has grown more complex because of a previous understanding between the two sides. In 2025, Montana agreed to pause enforcement while similar litigation in other jurisdictions played out. Kalshi now claims the state has walked away from that commitment by sending a new cease-and-desist notice even though related appeals are still pending.

This lawsuit is part of a wider pattern. Kalshi has been engaged in several legal battles across the country, including cases in Arizona, New Jersey, and Massachusetts. Some courts have leaned toward recognizing federal authority in this area, blocking state-level enforcement for now. However, dissenting judicial opinions and regulatory pushback highlight the lack of consensus.

Kalshi warns that allowing each state to impose its own rules could fragment the market and disrupt how regulated exchanges function. The company also points to the risk of financial and reputational damage if enforcement proceeds before the courts provide clarity.

For now, Montana officials have not yet responded in court. The outcome of this case could play a substantial role in shaping the future of prediction markets as regulators and lawmakers continue to debate whether these platforms belong in the world of finance or gambling.
