The dispute itself stretches back several years and extends well beyond Brazil. During earlier litigation, Aviator LLC claimed that Spribe used the Aviator name without permission because it had registered trademarks in bad faith and infringed on existing intellectual property. A 2024 court decision supported Aviator LLC, resulting in financial penalties for Spribe and invalidating some of its trademark registrations.
Spribe continues to defend its stance, including its efforts to obtain interim relief in other jurisdictions, such as the United Kingdom. These efforts have produced mixed outcomes due to a fragmented legal landscape where court rulings may depend heavily on jurisdiction and timing.
