Judge: Bally’s Twin River Casino Cannot Be Held Responsible for Robbery of Guest

A US District Court judge has ruled that Bally’s Twin River Casino is not responsible for the robbery of a patron. While the plaintiff insisted that it should have been the casino’s responsibility to keep patrons safe, the judge was not convinced since the robbery happened far from the gambling property.

The Man Says the Casino Should Have Protected Him

The incident occurred in 2021 shortly after plaintiff Edward Peduto departed from the Twin River Casino in Lincoln. On his way home, he stopped at a service plaza in North Lexington where he was robbed by criminals.

Peduto claims that the criminals had targeted him at the casino and had followed him for miles as he drove to his home in Wakefield. Once he stopped, they jumped at the opportunity and took his money.

Since the robbers were present at the casino, Peduto and his lawyers argued that it should have been Bally’s Twin River Casino’s responsibility to protect their players. The plaintiff argued that the situation could have been prevented if the casino had monitored what was happening and had installed sufficient security.

Peduto further insisted that the casino was aware of such instances of crime against its customers and should have been vigilant.

There Was Nothing Bally’s Could Have Done

Judge Allison D. Burroughs examined the matter and confirmed that the robbers did indeed appear on the casino’s security footage. They were seen leaving the premises at the same time as the plaintiff and other patrons but, by that point, had not committed any suspicious or criminal actions.

The judge said that there was no indication that the criminals would attack Peduto. Although she regretted the robbery, she pointed out that Bally’s Twin River Casino cannot be held responsible since it had no opportunity to identify, predict and prevent the incident.

Judge Burroughs concluded that since the attack happened 50 miles away, Bally’s Twin River and its owners could not realistically do anything.

In other news, the police in Atlantic City arrested a serial thief who stole a cash envelope from a casinogoer’s purse. As it turned out, the man had a long history of thievery and had served prison sentences.  

Elsewhere, a man drove an SUV off the roof of a parking garage, crashing through the roof of Bally’s Casino Evansville. The man had been struggling with mental health issues and had stopped taking his medication, according to recent reports.
