Aviator LLC Secures Landmark Legal Win in Trademark Dispute

In a significant court win for intellectual property enforcement in the gaming industry, the Supreme Court of Georgia has rejected an appeal by rival game developer SPRIBE and upheld Aviator LLC’s right to sole ownership of the “Aviator” trademark name and airplane logo in its home country. This ruling follows an earlier settlement between Aviator and Flutter Entertainment, strengthening the brand’s IP.

The Decision Could Set a Significant Precedent

The May 20, 2025, court decision deemed SPRIBE’s appeal inadmissible, thereby upholding earlier judgments that determined that SPRIBE’s registration of the “Aviator” trademarks was made in bad faith and infringed upon Aviator LLC’s original copyright. This judgment concludes a legal dispute that began in 2021 when SPRIBE registered its own Aviator-related trademarks for gambling and gaming services.

The court ruling reaffirms that Aviator LLC is the legitimate owner of the Aviator name and its broadly recognized airplane logo. This development marks a pivotal moment in a long-running international battle over intellectual property revolving around one of the most well-liked crash-style games on the market.

The ruling also strengthens Aviator LLC’s position in numerous pending cases worldwide. Most notably, the company is currently engaged in a trademark invalidation action against SPRIBE at the European Union Intellectual Property Office (EUIPO). Legal experts believe that this newest court decision could set a precedent across the EU, especially since Georgia is the country of origin for the Aviator IP.

Aviator Was Involved in Several Other Lawsuits

Created by Aviator LLC, the “Aviator” game challenges players to place bets before a virtual airplane takes off. As the plane rises, so do the potential winnings. However, the aircraft can fly away at any moment, cutting off profits for those who don’t cash out in time. The simple yet engaging mechanic has become a core feature in online gaming platforms worldwide.

This legal victory follows a February 2025 settlement between Aviator LLC and gambling giant Flutter Entertainment in a similar trademark infringement lawsuit. The parties reached an agreement in which Flutter acknowledged Aviator LLC’s rights to the name and logo. Meanwhile, the game developer allowed the operator to continue offering the game in compliance with those rights.

As Aviator LLC continues to expand its global presence, the ruling from Georgia’s highest court is a significant step in asserting control over its brand. The dispute underscores growing concerns in the digital gambling sector, where the rapid proliferation of similar games has raised questions over brand protection, originality, and market integrity.
